The flood hazard rule and DBPR's class list
The permit exemption in section 553.79(1)(g) doesn't apply to work on a property partly or entirely inside a flood hazard area as the Florida Building Code defines it. If any part of your lot lies in one, no job there qualifies for the exemption, whatever its value.
DBPR's class list includes Plumbing and Underground Utility and Excavation, with no class called waterproofing. Ask a company which class it holds for the job you're describing.
Waterproofing in Florida: our estimate and the wages behind it
Waterproofing is modeled at $3,550 to $10,900 per project, from national published ranges (2 counted) scaled by Florida's construction laborer wage ratio (0.87). It's an estimate, not a quote, with no Florida company price in it.
| Item | Figure | What it is |
|---|---|---|
| Estimated range, not a quote | $3,550 to $10,900 per project | Built from 2 national published ranges, adjusted by the Florida construction laborer wage ratio (0.86). One Florida foundation company publishes a price we could count on their own websites; where five or more price the same job, the range is the middle half of their prices, and where two to four do, the estimate is widened to take them in. Coupons, specials and figures a page gives as an average are not counted. Basis: no state company sample (no counted Florida company price for this job), national estimate only. |

The permit and contractor rules that apply anyway
Section 553.79(1)(a) makes it unlawful to repair or alter any building in Florida without a permit from the enforcing agency, and section 489.113(2) requires certification or registration to engage in contracting. Ask the building office whether your waterproofing scope is a repair or alteration there.
Chapter 558 defines a construction defect to include a deficiency in construction, repair, alteration or remodeling of real property. A written notice of claim goes out at least 60 days before a suit is filed.
Water in the house that shouldn't wait
- Water is spreading across a lower floor and has reached outlets or the panel; stay out.
- Water is pushing through a wall or floor joint in a steady stream.
- Dark staining is spreading across a wall that was dry last month.
- Damp patches on a wall after heavy rain that dry out within a day.
Before you accept a waterproofing bid
- Note where water enters and what the weather was the day before.
- Ask the company to name the license class on its DBPR record.
- Ask for the scope in writing, with what is drained, sealed and pumped.
Permits for waterproofing in Florida
Section 553.79 requires a permit to repair a building, and the exemption excludes plumbing, structural, electrical and mechanical work. Describe the scope to your building office and ask which permit, if any, it files the job under.
DBPR has no foundation repair license category, so ask which state contractor license the company holds, look the number up on myfloridalicense.com and get its certificate of insurance before you sign anything.
Questions people ask
Does Florida regulate basement waterproofing?
Through the general rules: section 553.79 for permits and chapter 489 for who may contract. Section 553.79 covers repairs and alterations to buildings, and section 489.113(2) requires anyone in the business of contracting to be certified or registered.
Does waterproofing need a permit in Florida?
Ask your building office; the $7,500 exemption doesn't cover plumbing or structural work. Mention it if any part of the lot is in a flood hazard area, which rules out the exemption.
